The Crown Prosecution Service (CPS) neither confirmed nor denied holding information relating to the individual named in the request, citing section 40(5) (personal data) of the FOIA. The Commissioner's decision is that the CPS was not obliged to confirm or deny if the requested information was held by virtue of section 40(5)(b)(i) of the FOIA. The Commissioner requires no steps to be taken as a result of this decision.
