The complainant has made a two requests in respect of assets (and specifically one residential property) owned by Bolton Borough Council. The Council refused both requests as vexatious under section 14(1) of the Freedom of Information Act. The Commissioner’s decision is that Council is entitled to refuse request 1 under section 14(1), but is not entitled to refuse request 2. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation: Issue a fresh response to request 2 under the terms of the FOIA.
