The complainant has requested information relating to a deceased officer. Staffordshire Police withheld the information citing sections 30(1)(a) and (b) (Investigations and proceedings); 31(1)(1)(g) by virtue of 31(2) (Law enforcement) and 38(1) (Health and safety) of the FOIA to some of it. Staffordshire Police also confirmed that it did not hold the remainder of the requested information.
The Commissioner’s decision is that Staffordshire Police has applied section 38(1)(a) of the FOIA appropriately to some of the information. She also considers that Staffordshire Police is correct to state that it does not hold the remainder of the requested information. However, the Commissioner considers that Staffordshire Police has breached section 10 (Time for compliance) and section 17 (Refusal of a request) of the FOIA.
The Commissioner does not require Staffordshire Police to take any steps as a result of this decision.
