The Home Office confirmed it held information within the scope of the request but refused to provide it, citing section 42(1) (legal professional privilege) of FOIA. The Commissioner’s decision is that the Home Office is entitled to rely on section 42(1) of FOIA to withhold the requested information. The Commissioner requires no steps to be taken as a result of this decision.
