The complainant submitted a request to Anglia Ruskin University (the university) for information regarding academic misconduct and plagiarism amongst its students for a specific time period.
The university refused to disclose the requested information, citing section 43(2) (commercial interests) of FOIA as its basis for doing so.
The Commissioner’s decision is that the university was not entitled to rely upon section 43(2) to withhold the requested information.
The Commissioner requires the university to take the following steps to ensure compliance with the legislation.
• Disclose the requested information.
The university must take these steps within 30 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
