The complainant has requested from the London Borough of Newham (“the Council”) a copy of the minutes from West Ham’s Safety Advisory Group meetings since January 2013. The Commissioner’s decision is that the Council was partially correct to rely upon the exemption set out at section 40(2) to withhold the names of the individuals that attended the meetings from non-public authorities. However the Council has incorrectly applied section 40(2) to the names of the individuals that attended the meetings from public authorities. The Commissioner has also determined that a number of redactions are not considered to be personal data and do not fall under the exemption set out at section 40(2). He therefore requires the Council to release the names of the individuals that attended the meetings from public authorities and to release the information numbered 1 - 17 in Annex A.
