The complainant has requested from the Royal Borough of Greenwich (the ‘Council’) the number of Council employees that have been dismissed for misconduct during a specific period and for details of the offences. The Council disclosed some information falling within the scope of the request and it confirmed that information is not held for the remaining parts of the request. The Commissioner’s decision is that on the balance of probabilities, the Council does not hold any further information within the scope of the request other than that which has already been provided. Therefore the Council has not breached section 1(1) of the FOIA. However, the Commissioner finds that the Council has breached section 10(1) of the FOIA as it failed to disclose some of the requested information within the statutory timeframe of 20 working days. The Commissioner does not require the Council to take any steps.
