The complainants requested information relating to the care of a deceased relative. Some of the information was releasable under the Freedom of Information, while some was more appropriately covered under the terms of the Medical Records Act 1990 or the Data Protection Act 1998. The PCT did not provide the information within 20 working days nor did it issue a Refusal Notice informing the complainants that parts of the request were to be released under different legislation.
