In this matter the complainant made a series of Freedom of Information requests of the public authority. The requests were refined and the Commissioner has made a decision about three outstanding items. The Commissioner has concluded that all of those items, in this context, constitute the complainant’s personal data and therefore they are exempt under section 40(1) and should have been considered under section 7 of the Data Protection Act 1998. He has found a breach of section 17(1)(b) in relation to the refusal notice provided in respect of one of the requests. He has not ordered any remedial steps. Information Tribunal appeal EA/2009/0009 has been withdrawn.
