The complainant asked Her Majesty’s Courts Service (the “public authority”) to provide information relating to the job interview of a third party. The public authority refused to disclose this using the exemption under sections 40(2) of the Freedom of Information Act 2000 (the “Act”). The Commissioner considers that section 40(2) by virtue of 40(3)(a)(i) was correctly applied in this case and that disclosure would breach the Data Protection Act 1998 (the “DPA”). The Commissioner requires no steps to be taken. The complaint is not upheld. The public authority’s handling of the request also resulted in breaches of certain procedural requirements of the Act as identified in this Notice.
