The complainant requested information about post-dismissal financial settlements agreed by the public authority. The information was refused under the exemptions provided by sections 40 and 43 of the Act. The Commissioner has considered the public authority’s arguments and he finds that the information was correctly withheld under section 40 of the Act. He has therefore not gone on to consider the applicability of section 43 of the Act any further, however he notes that the refusal notice issued by the public authority was deficient and that this constitutes a breach of section 17 of the Act. Information Tribunal appeal number EA/2011/0073 dismissed.
