The complainant asked the Crown Prosecution Service (the “public authority”) to provide a schedule of information relating to the prosecution of a named individual. The public authority refused to disclose this using the exemption under section 40 (personal information) of the Freedom of Information Act 2000 (the “Act”). The Commissioner’s decision is that the exemption in section 40(2) is engaged for the entirety of the information and that disclosure would breach the Data Protection Act 1998 (the “DPA”). The complaint is not upheld. Information Tribunal appeal number EA/2011/0112 part allowed.
