The complainant requested information relating to specific radiation figures on a graph in his possession. The MOD eventually concluded that none of the requested information was held. The Commissioner has investigated and finds that the MOD was correct in this response, but breached section 10(1) in responding outside the statutory time limit. He requires no further remedial steps to be taken. Information Tribunal appeal EA/2011/0178 allowed.
