On 8 September 2010 the complainant requested information from Cumbria County Council (‘the council’). Following the Commissioner’s Decision Notice of 31 March 2011, the council stated that the information had been provided on a repeated basis. The Commissioner investigated and found that the information was environmental and the council was entitled to refuse to disclose the information under the exception at regulation 12(4)(b) of the Environmental Information Regulations in that the request was manifestly unreasonable and the public interest in maintaining the exception outweighs the public interest in disclosure. The council is not required to take any further steps in respect of this complaint. Information Tribunal appeal number EA/2011/0192 dismissed.
