The complainant requested information from the Environment Agency (the Agency) about the prosecution of an individual who was found guilty of causing a pollution incident which resulted in the deaths of hundreds of fish at a nearby fishery. The Commissioner’s decision is that the Agency has correctly applied regulations 12(3) and 13(1) of the EIR. He does however find that the Agency failed to comply with regulation 14 of the EIR. The complainant also asked the Commissioner to consider whether the Agency breached regulations 6(1)(a), 9(1) and 12(11) of the EIR. The Commissioner has not upheld these aspects of the complaint. The Commissioner does not require the Agency to take any steps.
