The complainant requested all information held by the Office of Communications (‘Ofcom’) that relates to the change in responsibility for investigating transmission complaints after the duty was taken over by the BBC as a consequence of the termination of a contract between the corporation and the regulator. The Commissioner has identified a number of procedural shortcomings in the way that Ofcom handled the complainant’s request. The Commissioner’s decision is that Ofcom breached section 1(1), 10(1) and 17(1) of the FOIA. The Commissioner requires no remedial steps to be taken in this case.
