The complainant requested information from the London Borough of Enfield (“the council”) about payments for repairs relating to Botany Bay Farm. The council provided some information, but sought to withhold other information using the exemptions under section 40(2) and 43(2) under the Freedom of Information Act 2000 (“the FOIA”), or in the alternative, regulation 13(1) and 12(5)(e) of the Environmental Information Regulations 2004 (“the EIR”). These provisions concern third party personal data and prejudice to commercial interests. The Commissioner’s decision is that the information has been correctly withheld using the exemptions under section 40(2) and 43(2), with the exception of the name of a council staff member that the Commissioner considers was not exempt. The Commissioner also considers that the council breached section 1(1)(a), 1(1)(b), section 10(1) and 17(1) of the FOIA. The Commissioner requires the public authority to disclose the name of the staff member who wrote the feasibility report
