The complainant requested details, on a case by case basis, as to how the council’s Exceptions Panel, responsible for considering exceptional circumstances in the context of housing applications, had decided whether to award or not award additional points. The Commissioner’s decision is that the council does not hold the information sought, but has breached section 1(1)(a) by failing to confirm this to the applicant. The Commissioner requires the public authority to take no steps.
