The complainant has requested the business plan for a free school application. The Commissioner’s decision is that the Department for Education (DfE) has incorrectly applied section 36(2)(c). He has also decided that section 40(2) was applied incorrectly. However, his decision is that section 43(2) has been correctly applied to the capital costs of the site. The Commissioner requires the public authority to provide the information requested except for the information he has identified as being exempt under section 43(2).
