The complainant has requested a copy of the successful supplier’s submission for the Data Centre Storage Tender. Telford & Wrekin Council (the “council”) provided the complainant with a redacted version of the information and withheld the remaining information under the exemptions for personal data, information provided in confidence and commercial interests. The Commissioner’s decision is that: the council has correctly applied the exemptions for personal data and information provided in confidence; and the exemption for trade secrets is not engaged. The exemption for prejudice to commercial interests is engaged but the public interest favours disclosure of the information. The Commissioner requires the public authority to disclose the information withheld under the exemptions for trade secrets and prejudice to commercial interests. Information Tribunal appeal EA/2013/0035 allowed.
