The complainant requested from the Marine Management Organisation (“MMO”) a list of vessels sent to the EU Commission in 2003. The MMO applied regulation 12(4)(a) of the EIR on the basis that it did not hold the requested information. The Commissioner’s decision is that the MMO has correctly applied regulation 12(4)(a) as it does not hold the requested information. However, he identified some breaches of the EIR in the MMO’s handling of the request.
