The complainant made requests to East Sussex County Council (“the council”) relating to issues involving his wife. The council cited section 14(1) of the Freedom of Information Act 2000 (“the FOIA”), the exclusion relating to vexatious requests. The council also said that some of the requests should be considered separately under the terms of the Data Protection Act 1998 (“the DPA”). The Commissioner’s decision is that the council correctly relied on the exclusion under section 14(1) in relation to information that falls within the scope of the FOIA.
