The complainant requested risk assessments carried out on the seafront by Portsmouth City Council in the last 2 years. The council initially stated that no such assessments existed, but subsequently a risk assessment was provided to the complainant dated 2010. This was provided to the complainant outside of the 20 day period required by section 10(1) of the Act. The Commissioner’s decision is that Portsmouth City Council has breached section 10(1). The Commissioner does not require the authority to take any steps.
