The complainant requested information about an investigation into the Headteacher of a particular school. Wiltshire Council (‘the Council’) withheld the information requested under section 40(2). During the course of the Commissioner’s investigation the Council disclosed some information but maintained that the remaining information was exempt under section 40(2) of the FOIA. The Commissioner’s decision is that the Council has correctly applied section 40(2) to the remaining information held relevant to the request. He does not require any steps to be taken.
