The complainant has requested information from the DWP concerning the criteria to be used in Work Capability Assessments and the DWP’s consideration of factors affecting this. The DWP provided a late response to the request. The Commissioner’s decision is that the DWP has failed to provide a response to the request within the statutory time frame of 20 working days. He upholds the complaint but requires no further action to be taken as a response has been provided to the complainant.
