The complainant has requested information regarding the use of the Regulation of Investigatory Powers Act 2000 within prisons. The Commissioner’s decision is that the Ministry of Justice (“MOJ”) was correct to rely on section 31(3) to neither confirm nor deny it held some of the requested information and where it did confirm it held requested information it correctly relied on section 31(1)(a) not to communicate it to the complainant.
