It refused to confirm or deny whether it held the requested information relying on section 40(5) of FOIA. The Commissioner’s decision is that the public authority correctly relied on section 40(5) to neither confirm nor deny it held the requested information. Information Tribunal appeal (EA/2013/0216) struck out.
