The complainant has requested information relating to a planning process that is taking place for a local skate park. Steyning Parish Council (the council) has refused to respond to the request relying on regulation 12(4)(b) of the EIR deeming it to be manifestly unreasonable. The Commissioner’s decision is that the council has breached regulation 14(5)(a) of the EIR in failing to advise the complainant of his right to make representation to the public authority under regulation 11 of the EIR in its refusal notice. He does not require any steps to be taken in this case, but the council should ensure there is no repetition of this breach. The Commissioner has then gone on to conclude that the council have correctly relied on regulation 12(4)(a) of the EIR. The Commissioner requires no steps to be taken.
