The complainant has requested copies of Rotherham Metropolitan Borough Council’s (‘the council’) annual IT health checks. The Commissioner’s decision is that the council is not entitled to rely on the exemption for health and safety at section 38 of the FOIA as a basis to withhold the requested information. The Commissioner requires the public authority to disclose the requested information. Information Tribunal appeal EA/2013/0249 diposed of by consent.
