The complainant has requested copies of any email correspondence between the health adviser to the Prime Minister and the director of the NHS Partners Network. The Cabinet Office refused the request, citing the exemption at section 36(2)(c) of the FOIA. The Information Commissioner’s decision is that although the exemption is engaged, the public interest in maintaining the exemption does not outweigh the public interest in disclosure. The Commissioner requires the public authority to disclose to the complainant the information it has identified as falling within the scope of his request.
