The complainant has requested information from Cleveland Fire Brigade (“the fire brigade”) relating to four named companies. The fire service refused to supply the requested in formation in reliance of the exemptions provided by sections 24(1) (national security) and 38 (health and safety) of the FOIA and regulation 12(5)(a) of the EIR. The Commissioner’s decision is that the fire brigade is entitled to rely on section 24(1) of the FOIA as the basis for withholding the information sought by the complainant. No steps are required.
