The complainant has requested the number of Incapacity Benefit and Employment and Support Allowance claimants who have died in 2012. The Department for Work and Pensions (DWP) refused the request as vexatious under section 14(1) of the FOIA. The Commissioner’s decision is that the DWP has correctly applied the vexatious provision at section 14(1) of the FOIA. He does not require any steps to be taken. Information Tribunal EA/2013/0277 dismissed.
