The complainant has requested correspondene relating to a previous request for information. The council has applied Regulation 12(4)(e) (internal communications) and Regulation 12(3)(personal data). The Commissioner’s decision is that Shropshire Council was correct to apply Regulation 12(4)(e) to the information and that the public interest rests in the information being withheld. However he has decided that the authority did breach Regulation 14(3)(b) in that it did not specify the arguments and factors it considered when carrying out the public interest test. The Commissioner has also decided that the council was correct to apply Regulation 12(3) to the information. Again however the authority did not comply with the requirements of Regulation 14(3)(b) when providing its refusal notice to the complainant. Information Tribunal EA/2014/0030 allowed in part.
