The complainant requested information relating to a pre-planning application advice request. The Commissioner’s decision is that the public authority was entitled to withhold the requested information on the basis of the exception at regulation 12(5)(b). The Commissioner however finds the public authority in breach of regulation 14(2) for failing to respond to the request within 20 working days. The Commissioner does not require the public authority to take any steps.
