The complainant has requested a copy of an audit of North Yorkshire education provision for children and young people with autism carried out in March 2012. The council withheld the information on the grounds that 36(2)(b)(i)&(ii) applied. The Commissioner’s decision is that North Yorkshire County Council was correct to apply section 36(2)(b)(i)&(ii) however the public interest in maintaining the exemption does not outweigh the public interest in the information being disclosed in this instance. The Commissioner has however decided that one small section of the withheld information should be withheld on the basis that the information is personal data and that the exemption in section 40(2) applies.
