The complainant has requested information about Work Capability Assessments. The Department for Work and Pensions (DWP) disclosed some of the information but refused to disclose the remainder, citing section 12 of the FOIA (cost of compliance exceeds appropriate limit). The Commissioner’s decision is that the DWP has correctly applied section 12 but has not complied with the obligation under section 16 to provide advice and assistance. The Commissioner requires the public authority to provide the complainant with advice and assistance, under section 16 of the FOIA.
