The complainant has requested environmental health reports made for a specified address. The council confirmed that it did not hold any information within the scope of the request. The complainant then asked the Commissioner to consider whether the information was held. The Commissioner’s decision is that, on the balance of probabilities, the information is not held by the council. However, the council breached regulation 5(2) of the EIR by failing to provide its response to the complainant within 20 working days. The Commissioner does not require any steps to be taken.
