The complainant requested information in respect of two documents which the Public Service Ombudsman for Wales (‘the PSOW’) had previously refused to provide in response to a subject access request. The PSOW refused to disclose them by virtue of section 40(2) and section 44(1) of the FOIA. The Commissioner’s decision is that the PSOW correctly relied on section 40(2) of the FOIA in relation to these documents. The Commissioner requires no steps to be taken.
