Bradford Metropolitan District Council

The complainant has requested information about union convenors. Bradford Metropolitan District Council (the council) provided the information it held except for the substantive posts and pay grades of the convenors, relying on section 40(2) and 40(3) of the FOIA to withhold it. During the course of the Commissioner’s investigation, the council decided to release the substantive posts, but maintained that the pay grades were still exempt. The Commissioner’s decision is that the council has incorrectly relied on section 40(2) and 40(3) to the information it has withheld. The Commissioner requires the public authority to provide the complainant with a copy of the withheld information.
