The complainant has requested information related to a previous FOIA request he had made to the Crown Prosecution Service (“CPS”). The CPS cited section 36 (prejudice to the effective conduct of public affairs) as a basis for refusing the requested information. It upheld this position after an internal review. The Commissioner’s decision is that the CPS is entitled to rely on the exemption it has cited as a basis for refusing the requested information. However, the CPS contravened its obligations under section 10 of the FOIA in failing to respond within 20 working days. No steps are required.
