The complainant has requested a copy of the review by a named individual into a Doctor’s Fitness to Practice case. The General Medical Council (GMC) argued that this information was exempt from disclosure on the basis of section 42 (legal professional privilege) of FOIA. The Commissioner’s decision is that the requested information is exempt from disclosure on the basis of section 42 and that in all the circumstances of the case the public interest favours maintaining the exemption.
