The complainant has requested information relating to the proposed development of sports stadia throughout various areas of Belfast. The Department of Culture, Arts and Leisure (DCAL) refused to disclose the information, citing the exceptions as set out in regulations 12(4)(d) and 12(5)(e) of the Environmental Information Regulations (EIR) as a basis for non-disclosure. The Commissioner’s decision is that DCAL has correctly applied regulation 12(5)(e), which applies to the entirety of the requested information. He has not considered DCAL’s application of regulation 12(4)(d).
