  • Decision(s) FOI 43: Not upheld

The complainant requested from the Home Office (HO) the actual annual cost of each Immigration Removal Centre (IRC) for the last year for which information was available, along with other information concerning the operation of IRCs. HO disclosed some relevant information but withheld the annual cost data for each IRC relying on the section 43(2) FOIA commercial interests’ exemption. The Information Commissioner decided that, for the withheld information, the section 43(2) exemption was engaged and that the balance of the public interest favoured maintaining the exemption. The Commissioner does not require HO to take any steps to comply with the legislation. Information Tribunal EA/2014/0091 dismissed.
