The complainant made a series of requests to Ashford Borough Council (“the Council”) over a period of months in relation to issues following a change of use in premises from a Laundrette to a Fish and Chip shop. The Council responded to the majority of the requests but after a period of time advised the complainant that it would not answer further FOIA requests on the same issue as the requests were vexatious under section 14(1) of the FOIA and, in so far as they related to environmental information, manifestly unreasonable under regulation 12(4)(b) of the EIR. The Commissioner’s decision is that the Council has correctly applied section 14(1) of the FOIA and regulation 12(4)(b), in so far as it relates to environmental information. There are no further steps to be taken. Information Tribunal appeal EA/2014/0088 dismissed.
