Commissioner of the Metropolitan Police Service

  • Date 22 April 2014
  • Sector Police and criminal justice
  • Decision(s) FOI 30: Not upheld
The complainant has requested information which relates to an alleged crime with which she was involved. The Metropolitan Police Service (the “MPS”) would neither confirm nor deny holding any of the requested information by virtue of sections 40(5)(personal information) and 30(3) (investigations and proceedings). The Commissioner’s decision is that the exemption at section 30(3) was engaged and that the public interest in maintaining the exclusion of the duty to confirm or deny outweighed the public interest in disclosing whether the MPS holds the information. As it was entitled to rely on section 30(3) he has not gone on to consider section 40(5). He does not require any steps.
