Barnet Enfield and Haringey Mental Health NHS Trust

The complainant has requested from Barnet Enfield & Haringey Mental Health Trust (the “Trust”) a copy of the Datix incident form. The Trust provided the complainant with a copy of the requested information and confirmed that the form had not been changed other than the removal of patient identifiable information. The Commissioner considers that the Trust was correct to confirm that it did not hold any further information, other than that which was provided to the complainant, under section 1(1)(a) of the Freedom of Information Act 2000 (FOIA). However, the Commissioner identified that the response from the Trust was provided outside of 20 working days, and therefore breached the requirement of section 10(1) of the FOIA. The Commissioner requires no steps to be taken. Information Tribunal EA/2014/0106 allowed.
