The complainant requested information about School Travel Plans, in electronic form, from the London Borough of Richmond-upon-Thames (‘LBRUT’). Initially, LBRUT refused the request on the grounds that it considered it to be manifestly unreasonable (regulation 12(4)(b) of the EIR). Following an exchange of correspondence clarifying the request, LBRUT supplied the requested information with some minor redactions of personal information which the complainant accepted. This information was provided 61 working days after the request was made. The Commissioner’s decision is that LBRUT breached regulation 5(2) of the EIR by failing to provide the requested information within 20 working days. It also breached regulation 11 by failing to carry out an internal review. However, as the information has been provided to the complainant, the Commissioner does not require LBRUT to take any remedial steps.
