The complainant has requested information with regards to a development site near to his property. He had concerns with possible landslips and pollution. East Devon District Council (the council) provided the complainant with some of the information it held, and referred him to its planning website for the remainder, relying on section 21 of the FOIA. After an internal review the council provided the complainant with hard copies of the information it held on its website, no longer relying on section 21 of the FOIA. The complainant is not satisfied that he has been provided with all the information held by the council within the scope of his request. The Commissioner’s decision is that, on the balance of probabilities, the council has provided the complainant with all of the information it holds within the scope of his request. The Commissioner does not require the council to take any steps.
