The Commissioner’s decision is that Bournemouth Borough Council correctly relied on section 40(2) to withhold the requested information as regards non-corporate leaseholders. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation. Provide the complainant with the names of corporate leaseholders of former local authority properties within its boundaries held by Bournemouth Borough Council.
