The complainant has requested the name of the officer/s who authorised the detention of David Miranda at Heathrow Airport. The Metropolitan Police Service (the “MPS”) refused to provide the information citing sections 23(5)(security services), 24(1) (national security), 30(1) (investigations and proceedings) and 40(2) (personal information). The Commissioner’s decision is that the MPS was entitled to rely on section 40(2); he does not require any steps.
